General Terms and Conditions of Sautter All Natural GmbH & Co. KG
disana is a brand of Sautter All Natural GmbH & Co. KG.
In the event of any discrepancy, the German version shall prevail.
1. Scope
The following General Terms and Conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.
For Germany: Under § 13 of the German Civil Code (BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
For Austria: In the following terms and conditions, “consumer” refers to a “Konsument” within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG).
2. Contractual partner, formation of contract, options for corrections
The purchase contract is concluded with Sautter All Natural GmbH & Co. KG.
By placing the products in our online shop, we make a binding offer to conclude a contract for these items. You may initially place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping basket by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.
3. Contract language, storage of the contract text
Language(s) available for concluding the contract: German, English
We store the contract text and send you the order data and our General Terms and Conditions in text form. If you have created a customer account, you can view your order data there.
4. Subject matter of the contract
4.1 Product description
Please note that the respective product description forms an essential part of the contract. We are entitled to withdraw from the contract if an incorrect item was displayed, ordered or confirmed as a result of a technical or system-related error.
4.2 Product images and natural materials
Without prejudice to your statutory warranty rights, we would like to draw your attention to the following particularities. If you are unsure, please contact us:
Due to individual screen settings (e.g. resolution and brightness), slight differences between the displayed and the actual product colours are possible.
For products made from natural materials such as wool and other natural fibres, as well as for buttons made from corozo nut, natural variations in colour, structure and grain are possible.
5. Delivery conditions
We ship the products to the delivery address specified in the ordering process.
You generally have the option of collecting your order from the disana store, Rosenstr. 26, 72805 Lichtenstein, Germany, during our opening hours.
6. Payment
The following payment methods are generally available in our shop.
PayPal
In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), we offer you the following payment options as PayPal services. Unless otherwise stated below, payment via PayPal does not require registration with PayPal. You will find further information with the respective payment option and in the ordering process.
PayPal, PayPal Express
In order to pay the invoice amount via the PayPal payment option, you must be registered with PayPal, identify yourself with your login details and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order has been placed.
PayPal may offer registered PayPal customers, selected according to its own criteria, further payment options in their customer account. However, we have no influence on the offering of these options; any further individually offered payment options concern your legal relationship with PayPal. You can find further information on this in your PayPal account.
Credit card via PayPal
Payment by credit card is processed via PayPal; your card is charged by PayPal.
Direct debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. PayPal will inform you of the date on which your account will be debited (so-called pre-notification). Your account will be debited before the goods are dispatched.
Invoice
The invoice amount is due for payment by bank transfer to the bank account stated on the invoice 14 days after receipt of the invoice and the goods. We reserve the right to offer purchase on invoice only after a successful credit check.
7. Right of withdrawal
As a consumer, you have a right of withdrawal. You can declare your withdrawal directly online at disana-shop.com/widerruf.
8. Retention of title
The product remains our property until payment has been made in full.
9. Transport damage
If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us without delay. Failure to make a complaint or to contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurer.
10. Warranty and guarantees
10.1 Liability for defects
The statutory law on liability for defects applies.
10.2 Guarantees and customer service
Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.
11. Liability
We are always liable without limitation for claims arising from damage caused by us, our legal representatives or vicarious agents
- in the event of injury to life, body or health,
- in the event of an intentional or grossly negligent breach of duty,
- in the case of guarantee commitments, where agreed, or
- insofar as the German Product Liability Act applies.
In the event of a slightly negligent breach of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations), by us, our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected.
In all other respects, claims for damages are excluded.
12. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final provisions
Should individual clauses of these General Terms and Conditions be wholly or partly invalid, the remainder of the contract shall remain valid. Insofar as individual clauses are invalid, the content of the contract shall be governed by the statutory provisions.
